1. Acceptance of Terms

By accessing this website, enrolling in programs, or using any services provided by The Lab Baseball Performance LLC ("The Lab," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use our services.

For participants under 18, a parent or legal guardian must agree to these terms on the minor's behalf.

2. Services Description

The Lab Baseball Performance LLC provides baseball training, coaching, and player development for middle school and high school athletes in Bakersfield, California, including hitting and pitching development, player assessments, and related services. Program availability and schedules are subject to change.

3. SMS Terms (The Lab Baseball Performance text messages)

How you opt in: our website form has two separate checkboxes, one for marketing messages and one for non-marketing messages. Both are unchecked by default and both are optional. You opt in to a type of message only by checking its box. Submitting the form without checking a box does not opt you in to text messages.

Non-marketing messages include sales follow-up on your inquiry, confirmations and reminders for scheduled calls and visits, and training schedule updates for enrolled athletes.

Marketing messages include special offers, discounts, and service updates about our training programs.

Message frequency varies. Message and data rates may apply. Messages are sent from (661) 374-0603.

Opt out: Reply STOP to any message at any time. You will receive one confirmation message and no further texts.

Consent to receive text messages is not a condition of purchasing any program or service.

Age: You must be 18 or older to opt in. Text messages go to parents and guardians, who opt in on behalf of their athlete.

Carrier liability: Carriers (including T-Mobile, AT&T, Verizon, and other wireless carriers) are not liable for delayed or undelivered messages.

Privacy: We never sell, rent, or share your phone number or SMS opt-in information with third parties. See our Privacy Policy for full details.

4. Forms and Enrollment

When you submit our form or enroll in a program, you agree to provide accurate, current, and complete information and to keep your contact information up to date.

Parent or guardian information is required for all participants under 18. The adult submitting information is responsible for its accuracy.

5. Payment Terms

Program pricing and payment schedules are provided before enrollment and stated in your enrollment agreement. By enrolling, you agree to the pricing and payment schedule in that agreement.

  • Payments are due as stated in your enrollment agreement
  • Refund terms are stated in your enrollment agreement
  • Failure to make timely payments may result in suspension from training sessions

6. Assumption of Risk

Baseball training involves physical activity that carries inherent risks of injury. By participating in any program offered by The Lab Baseball Performance LLC, you acknowledge and accept these risks, including but not limited to:

  • Muscle strains, sprains, and soreness
  • Impact injuries from baseballs or equipment
  • Overuse injuries
  • Injuries resulting from physical conditioning

Participants and their parents or guardians assume full responsibility for any injuries that occur during training. Participants should disclose any medical conditions, injuries, or physical limitations before beginning any program.

7. Limitation of Liability

To the maximum extent permitted by law, The Lab Baseball Performance LLC, its owners, coaches, employees, and contractors shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in our programs or use of our services.

This includes but is not limited to damages for personal injury, property damage, loss of data, or any other losses arising from your use of our services.

8. Intellectual Property

All content on this website, including text, graphics, logos, images, training materials, and program designs, is the property of The Lab Baseball Performance LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content without prior written permission from The Lab Baseball Performance LLC.

9. Changes to Terms

We may update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted means you accept the revised terms.

10. Governing Law

These Terms of Service are governed by the laws of the State of California. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Kern County, California.
